1. Who we are

Dave The Plumber is built and operated by DMT Holdings and Consulting, trading as UN8 Brands, in the United States. In these terms, "we", "us" and "our" mean that business. "You" means the business that signs up for or uses the service, and the person accepting these terms on its behalf.

  • Contact: david@un8brands.com
  • Site: davetheplumber.app

2. Accepting these terms

By installing the Shopify app, creating an account on the web app, or otherwise using the service, you agree to these terms and to our Privacy policy. If you are accepting on behalf of a business, you confirm you have authority to bind it. If you do not agree, do not use the service.

3. What the service does

Dave The Plumber improves the conversion signal an ecommerce store sends to Meta. You can use it in two ways, and these terms cover both:

  • The Shopify app, installed from the Shopify App Store. Billing runs through Shopify's Billing API, and Shopify's own terms also apply to your use of it.
  • The standalone web app at www.davetheplumber.app. You sign in with a link we email you, you pay by monthly subscription through Stripe, and you connect your store by installing our JavaScript snippet and sending us order webhooks.

In either case, the service:

  • Collects browser events through our snippet or pixel, and order data through webhooks.
  • Hashes customer identifiers (email, phone, name, external ID) with SHA-256, and forwards events to Meta's Conversions API using credentials you provide.
  • Offers "Seal the leaks", which creates Meta custom audiences and adds them as exclusions on your own prospecting ad sets, only after you confirm (section 8).
  • Offers a cookie-consent banner tool, and a free ADA/WCAG accessibility scanner, which can also be used without an account (section 7).

We may add, change or remove features over time. If we remove something material from a paid plan, we will tell you in advance.

4. Eligibility and accounts

The service is for businesses, used for business purposes. It is not a consumer product. You must be old enough to form a binding contract where you live.

You are responsible for your account and for keeping sign-in access secure. For the web app, that means the email inbox our sign-in links go to: anyone who can read that inbox can sign in. For the Shopify app, it means your Shopify staff accounts and permissions. Tell us promptly at david@un8brands.com if you think someone has accessed your account without permission. You are responsible for what happens under your account.

Give us accurate information, and keep your contact email current — it is how we send billing notices and changes to these terms.

5. Your responsibilities

You run your store, your customer relationships and your ad account. The service acts on your instructions, so some things are yours alone:

  • Lawful basis and consent. You must have a lawful basis, including any consent the law requires, to collect your shoppers' data and send it to Meta for advertising measurement and targeting.
  • Your privacy notice. You are responsible for your own privacy notice, and for telling your shoppers that their data is shared with Meta.
  • Your consent choices. You decide how your consent banner is set up and which settings you turn on, including settings that forward orders without a storefront visit.
  • Your Meta ad account. You are responsible for your Meta ad account, your credentials, your spend, and compliance with Meta's advertising policies and business tools terms.
  • Only data you are allowed to send. Do not send us, or ask us to forward, data you are not permitted to share — for example data collected without the required consent, or categories of data Meta's terms prohibit.

6. Data and privacy

For shopper data, you are the controller and we are a processor acting on your instructions. Our Privacy policy explains what we process, what reaches Meta, how long we keep it, our sub-processors, and how deletion requests work. It forms part of these terms, and we do not repeat it here.

7. Tools that are not advice

Three parts of the service could be mistaken for professional advice or a guarantee. They are neither. Please read this section carefully.

7.1 The ADA / WCAG accessibility scanner

The scanner is an automated check, not a legal opinion. Automated testing finds only a portion of accessibility issues; many problems can only be found by people testing with assistive technology. A scan result does not certify that a site is accessible or compliant with the ADA, WCAG or any other law or standard, and it does not protect you against lawsuits, demand letters or complaints. For legal questions about accessibility, talk to a qualified lawyer.

The scanner is free and can be used without an account. It is provided as-is, and the same limits on our liability apply to it as to the rest of the service.

7.2 The consent banner

The consent banner is a tool, not legal advice. We provide the controls; you decide how to configure them and whether that configuration meets your legal obligations in the places you sell. Using the banner does not by itself make your store compliant with any privacy law.

7.3 Ad performance

We do not guarantee results. We make no promise about ad performance, event match quality scores, return on ad spend, cost per purchase, or any other outcome. Meta decides how it uses the events it receives, how it attributes them, and how it delivers your ads.

8. Changes in your Meta ad account

Most of the service only sends events to Meta. "Seal the leaks" goes further: it creates custom audiences in your Meta ad account and adds them as exclusions on your own prospecting ad sets.

  • We make those changes only after you explicitly confirm them in the app. We do not change your ads on our own.
  • You remain responsible for your ad account, including checking that a change suits your campaigns, and for the results and spend that follow.
  • You can reverse the change with Unseal, which removes the exclusions we added.

9. Plans, billing and cancellation

Plans. We offer a Free plan and paid monthly plans (currently Starter, Growth and Scale). Each plan has a monthly cap on the number of orders sent to Meta. Current prices and caps are shown in the app and on our website.

Reaching the cap. When you reach your plan's monthly cap, forwarding to Meta pauses for the rest of that month and resumes when the next month starts. You are not billed extra for orders above the cap, and those orders are not lost from your store — they simply are not forwarded to Meta by us that month. You can upgrade at any time to raise the cap.

How you are billed.

  • Shopify app: charges are made through Shopify's Billing API and appear on your Shopify bill. We never see your card details.
  • Web app: charges are made by Stripe as a monthly subscription to the payment method you give Stripe.

Renewal. Paid plans renew automatically each month until cancelled.

Cancellation. You can cancel at any time — in the Shopify app by changing plan or uninstalling, in the web app from your billing settings or by emailing us. Cancellation takes effect at the end of the current billing period, and you keep paid features until then.

Refunds. We do not refund partial months, unless the law requires us to.

Price changes. We may change prices or plan limits. We will give you notice by email or in the app before a price increase affects you, and it will apply from your next billing period after the notice. If you do not agree, you can cancel before it takes effect.

Taxes. Prices do not include taxes unless stated. You are responsible for applicable taxes, which Shopify or Stripe may collect with your charge.

10. Third-party services

The service depends on others: Meta, Shopify, Stripe and our hosting providers, among others. Each has its own terms, which apply to your use of them. We do not control them, and we are not responsible for their outages, their policy changes, or changes to their APIs. If a change by one of them stops a feature working, we will try to adapt, but we cannot promise to.

11. Acceptable use

You agree not to:

  • Send or collect data unlawfully, or send data you are not allowed to share (section 5).
  • Try to break, overload, probe or bypass the security or plan limits of the service.
  • Scrape the service, or copy, decompile or reverse engineer it, except where the law expressly allows it.
  • Resell or sublicense the service without our written agreement.
  • Use the service to break Meta's, Shopify's or Stripe's terms or policies.
  • Abuse the free scanner — for example with automated bulk scanning or scanning volumes meant to degrade the service.
  • Use the service on a store or website you do not own or control.

The scanner can scan any public URL. Only scan sites you are responsible for or are authorised to check.

12. Intellectual property and feedback

We own the service, including its software, design, content and the Dave The Plumber name. These terms give you a limited, non-exclusive, non-transferable right to use it for your business while your account is in good standing. Nothing else transfers to you.

You own your data. You give us permission to use it only to provide, secure and support the service, as described in the Privacy policy.

If you send us ideas or feedback, we may use them without any obligation to you.

13. Availability, suspension and termination

Availability. We work to keep the service running, but it is provided "as is" and "as available". We do not promise any particular uptime, and there may be interruptions for maintenance, bugs, or problems with the third parties in section 10.

Suspension. We may suspend your access, or pause forwarding, if you breach these terms, if your use creates a security or legal risk, or if payment fails. Where it is reasonable to do so we will tell you first and give you a chance to fix the problem.

Termination. You can stop using the service at any time by cancelling and, for the Shopify app, uninstalling. We may end your access for a serious or repeated breach, or end the service for everyone with reasonable notice.

Your data after termination. What we keep and when it is deleted is set out in the Retention section of the Privacy policy. Sections 7, 10, 12 and 14 to 18 continue to apply after these terms end.

14. Disclaimer of warranties

To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that every event will be forwarded or accepted by Meta, or that the results of any scan, banner configuration or audience change will be correct or suitable for your needs.

15. Limitation of liability

To the fullest extent the law allows:

  • We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost ad spend, lost data or loss of goodwill, even if we were told they were possible.
  • Our total liability for all claims relating to the service or these terms is limited to the fees you paid us for the service in the 12 months before the event giving rise to the claim. If you used only free features, that amount is zero.

Some places do not allow some of these limits, so they apply to you only as far as the law permits.

16. Indemnity

You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from: the data you send or instruct us to forward, including any lack of lawful basis or consent; your Meta ad account and your ads; your store and your privacy notice; or your breach of these terms or of the law.

17. Governing law and disputes

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute relating to the service or these terms will be heard only in the state or federal courts located in Los Angeles County, California, and both sides agree to those courts' jurisdiction.

Before starting any claim, please email us at david@un8brands.com so we can try to resolve it informally.

18. General

  • Entire agreement. These terms and the Privacy policy are the whole agreement between us about the service.
  • Severability. If a part of these terms is found unenforceable, the rest still applies.
  • No waiver. If we do not enforce a term straight away, we have not given up the right to enforce it later.
  • Assignment. You may not transfer these terms without our written agreement. We may transfer them as part of a sale or reorganisation of the business.
  • Events outside our control. We are not responsible for failures caused by events beyond our reasonable control, including outages at the third parties in section 10.

19. Changes to these terms

We may update these terms as the service changes. For material changes, we will give you notice by email or in the app before they take effect. If you keep using the service after that, the new terms apply; if you do not agree, you can cancel. The "last updated" date at the top always reflects the current version.
